Terms of Service

TongTong schedules Chinese vocabulary for review, estimates what you already know, and gives you graded reading with audio. It is a study tool, not a teacher, a translator, or an exam preparation guarantee: our content is compiled with care but may contain errors, and no particular learning result is promised.

We develop TongTong continuously. Features may be added, changed or withdrawn, and we may set or adjust technical limits to keep the service working for everyone. Where a change materially reduces what a paid subscription provides, the section on subscriptions below applies.

You must be at least 13 years old, or the higher minimum age set by the law of your country, and able to enter into a binding contract. If you are under the age of majority where you live, you may use TongTong only with the consent of a parent or guardian, who accepts these Terms with you. TongTong is not directed to children under 13 and we do not knowingly collect their personal information.

An account is personal to you. You agree to:

• give a working email address, and keep it current so we can reach you about your account;
• keep your sign-in method secure, and tell us at contact@tongtong.app if you believe someone else has used your account;
• use one account for yourself, rather than sharing it or letting anyone else sign in to it;
• take responsibility for what happens under your account.

Please do not:

• extract our vocabulary, example, grammar, story or audio content in bulk, by scraping, automated download or any other means, or use it to build or train another product;
• reverse engineer, decompile or attempt to derive the source of the apps or our systems, except where the law expressly permits it;
• resell, sublicense, rent out or otherwise commercialise access to TongTong or to a TongTong Plus subscription;
• interfere with the service — probing, overloading, circumventing rate limits or access controls, or working around the free-tier limits described below;
• use TongTong unlawfully, or to harass, abuse or impersonate anyone.

We may suspend or close an account that breaches this section, and we will tell you why unless the law prevents us.

You keep ownership of what you add — your nickname, your chosen avatar, the words you add to your own pipeline, and any feedback you send us. You grant us only the permission we need to run the service: to store that material, and to display the parts of it that are meant to be seen by others, such as a nickname on a leaderboard.

You are responsible for what you add, and it must not infringe anyone's rights or break the acceptable-use rules above. We may remove material that does, and we may use feedback you send us to improve TongTong without owing you anything for it.

TongTong, its apps, its design and its compiled content are owned by us or licensed to us. We grant you a personal, non-exclusive, non-transferable, revocable licence to use TongTong for your own learning, for as long as these Terms are in force. Nothing else is granted.

TongTong's grammar reference content is adapted from the Chinese Grammar Wiki by AllSet Learning, used under the Creative Commons Attribution-ShareAlike 3.0 (CC BY-SA 3.0) license.

TongTong has a free tier and a paid one, TongTong Plus. The free tier caps how many session items you can study in a rolling 24 hours and how many new stories you can open in a rolling 7 days; the figures in force are always shown in the app, on the screen where a limit is reached. TongTong Plus removes both caps and adds the further benefits listed on the subscription screen.

A subscription renews automatically. You are charged at the start of each billing period — monthly or yearly, whichever you chose — and it continues until you cancel. Cancelling stops the next renewal; it does not end the period you have already paid for, and you keep Plus until that period ends.

Where you bought it decides who bills you. This matters, because we can only change a subscription that we bill:

• On the web, at tongtong.app, we bill you through our payment processor, Stripe, in the currency shown at checkout. Manage or cancel it in Settings inside the app.
• In the iOS app, Apple bills you through the App Store under Apple's own terms (Apple Media Services Terms and Conditions). Manage or cancel it in your Apple account's subscription settings — we cannot cancel it for you.
• In the Android app, Google bills you through Google Play under Google Play's Terms of Service. Manage or cancel it in your Google Play account's subscription settings — we cannot cancel it for you.

The price you are shown is the price you pay. On the web we present one figure per billing period in your presentment currency. In the apps, Apple and Google set the price for each storefront, so the amount in your country may differ from the web price and from another country's; the store shows you the exact amount before you confirm. Prices may include or exclude tax depending on where you are.

We may change our prices. A change never applies to a period you have already paid for, and we will give you notice before it takes effect so you can cancel first. For a store subscription, Apple and Google run their own notice and consent process for a price rise.

Refunds — bought on the web. If you subscribed on tongtong.app you may cancel for a full refund within 14 days of the start of a new subscription, for any reason, wherever you live. Write to contact@tongtong.app and we will refund you. This is in addition to any statutory right you may have, and it does not apply to a renewal of a subscription you have already been using.

Refunds — bought in an app. Purchases made through the App Store or Google Play are refunded by Apple or Google under their own policies, and we can neither issue nor reverse them. Request one from Apple or from Google Play.

We sometimes grant a complimentary membership. It gives the same benefits, is not paid for, ends on the date shown in the app, and carries no right to renewal or to a refund.

If a payment fails and is not resolved, or a subscription ends for any other reason, your account returns to the free tier. Nothing you have learned is deleted — only the paid benefits stop.

You may stop using TongTong at any time, and you may delete your account from within the app. Deleting your account removes your personal data and learning history as described in the Privacy Policy, and it cannot be undone.

Deleting your account does not by itself cancel a subscription billed by Apple or Google. Cancel that in the store account that holds it, or it will keep renewing.

We may suspend or close an account that breaches these Terms, or where we must do so by law. If we close your account without cause while you hold a paid subscription that we bill, we will refund the unused part of the period.

TongTong is provided as it is. To the extent the law allows, we make no warranties of any kind — express or implied — about the service or its content, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not promise the service will be uninterrupted, error-free, or that any particular level of Chinese will result from using it.

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, data or goodwill. Our total liability arising out of or relating to TongTong is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, in which case the exclusions above apply only as far as that jurisdiction permits, and your statutory consumer rights are unaffected.

You agree to indemnify us against claims, damages and reasonable costs arising from your breach of these Terms, from material you add to TongTong, or from your unlawful use of the service. This does not apply to a consumer acting outside a trade or profession, where the law does not permit it.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and the courts of Wyoming have jurisdiction over any dispute.

If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory law of your country of residence, and you may bring proceedings in your local courts where that law gives you the right.

We may update these Terms. When a change is material we will revise the date above and tell you in the app or by email before it takes effect. Continuing to use TongTong after that means you accept the updated Terms; if you do not, you may cancel and delete your account.
